Graham cited anonymous ratings of judges submitted by lawyers. Some comments called Sotomayor "tempermental, excitable," "overly aggressive," "nasty to lawyers," and "a bit of a bully." Sotomayor explained that her circuit is known as a "hot bench" where lawyers are peppered with questions, but lawyers who are unfamiliar with the process of the second circuit find that courtroom style "difficult, and challenging." "If I may interject, Judge, they find YOU difficult and challenging, more than your colleagues," Graham countered.

  • Bach vs Equal Temperament, part 1 -- Bradley Lehman PART 1 OF 2. Five preludes from book 1 of Bach's "Well-Tempered Clavier" are performed on harpsichord, twice each. Part 1 of the video presentation has the preludes in B major, C major, and E major. Part 2 has the preludes in F minor and E-flat minor. The first performance of each pair is in equal temperament, and the second is in the "Bach/Lehman 1722" which I believe to have been Bach's own practice for this book of music. (Details: see ) The performances are by Bradley Lehman, May 31 2005. Same instrument, same camera, same day, trying to play as similarly as possible. All of the equal-temperament "takes" were recorded first, then the instrument retuned, and then all of the Bach-temperament takes. My own impression, hearing these 2 1 years later and editing them together into this presentation: the Bach temperament sounds enough like equal to fool just about anybody, and yet...it brings both more intensity and more relaxation to the music. In any event, it encourages me as a player to bend the music more freely and naturally, investing it with more nuances, in reaction to the sound. It makes me listen more closely to melody and counterpoint, the way the musical lines interact with one another. Tonality "locks in" with a subtly different character and mood for every key (scale). Equal temperament, by contrast, goes on and on with a relatively bland inoffensiveness...being less than inspiring, and encouraging "run-on" uninflected performances. The ...

  • Tuning a harpsichord in Bach's temperament - Bradley Lehman Tuning a harpsichord (cembalo, clavecin) in just a few minutes, by ear, using the tuning sequence I believe is illustrated on the title page of Bach's Well-Tempered Clavier (1722). Research by Bradley Lehman, 2004, continuing a doctoral project from 1993-4 in "modified meantone" tuning as applied to Bach's music. The interpretation is based on ***ysis of Bach's extant keyboard music, plus a historical study of tuning methods, plus (in 2004) the suspiciously irregular drawing on Bach's title page. This research was first published in an _Early Music_ (Oxford University Press journal) article, February-May 2005. Two printed portions and five web files comprise that article. This hands-on demonstration: 2007, Bradley Lehman at home. Flemish-style harpsichord built by Anne Acker. For full details about this tuning method and its musical implications, see . Articles, CDs, free online samples, links to additional resources. The articles show how Bach's drawing is mapped to the notes in the tuning sequence. FCGDAE 5ths (or 4ths) double-tempered; EBF#-C# pure 5ths C#-G#-D#-A# single-tempered (very slight). I believe this specific unequal tuning method was Bach's intention for at least that book of music, the Well-Tempered Clavier, playing music in all 24 major and minor keys. Time to set up the temperament by ear, from a single tuning fork: about 5 minutes. Time to do the entire instrument: about 8 to 20 minutes. As reported by Bach's son Carl Philipp Emanuel, it ...

  • Please Understand Me II: Temperament Character Intelligence [Closed Captioned] It has been over 11 years since its publication, and 31 years since its first incarnation as "Please Understand Me". And dare I say, used even longer (perhaps as early as the late 19th century) as a proto-model theory to gather information on people. However, with the changes in technology, culture, and the attitude of the western world, the question begs to be asked: Is the Myers-Briggs test still relatively accurate? The observed high population of "iNtuitives" out there raises both my skepticism and curiosity about the test. Perhaps, nowadays, with the value on creativity, people are less likely to see themselves as uncreative. Perhaps, other questions should be added to the book. I believe a large indicator of your personality type is your job. Now, I may have my detractors, saying, "You are not your job." However, I feel, that if anyone dedicates more than 4 hours a day towards something, isn't a rather large part of them that? After all, a large part of existence is dedicated towards a career. And furthermore, your job does give you the ability to function, hopefully in a comfortable capacity, in society. Thus, there is a psychological dependency on a job that is not mentioned at all in the book. And yet, I am willing to wager, there are some who would like to ignore that kind of question all together.
  • Buxtehude and Bohm: temperament examples (part 2) PART 2 OF 2. Four pieces of music (in F major, E minor, Eb major, and G minor) by Buxtehude and Bohm. Each piece is played three times, once each in a different temperament. The temperaments are shuffled for each piece: which is which, and which temperament works best for each piece? - Werckmeister III - Werckmeister III with three mystery notes moved by about 5 cents each - Werckmeister III with seven of the twelve notes moved; it is described here: Incidentally: one of the temperaments here has no wide 5ths, one of them has one very slightly wide 5th (only 704 cents), and one has two wider 5ths than that (about 707 or 708 cents). To find out which temperament is which, for each of the four selections, please send your guesses and comments to the e-mail address mentioned at the end of the video. All the recordings were made on the same harpsichord within about 1/2 hour of one another, to keep things as consistent as possible. Werckmeister III was really an organ temperament, not for harpsichords; and Werckmeister published a better harpsichord temperament a few years later. However, the most familiar temperament III (the first among his so-called "correct" temperaments in the 1691 book) is used here because it is in such widespread use among harpsichordists today. Can we do better? Will this direct comparison of the sound help us to do better? :) Personally, I feel that Werckmeister III makes my harpsichord sound abrasive and bitter, rather than welcoming ...

  • Introduction to unequal temperaments in F Sharp After a concert fundraising for David Pitches introduced us to the various unequal temperaments in F Sharp major - one of the most remote musical keys with lots of sharps. It's unplayable in the old Meantone temperament and various modifications were made to retain the character of different keys whilst mollifying the worst excesses of Meantone. Some composers went into keys like this very deliberately for specific purposes. • Temperament: Werckmeister 3 vs Bach/Lehman, part 1 A comparison of two possible temperaments for Bach's organ accompaniments in Leipzig. One is Andreas Werckmeister's most famous layout from a 1691 publication, and the other is a temperament I believe was Bach's own. The organ was tuned a whole step higher than the rest of Bach's ensemble, and therefore the organist for cantatas and passions always had to read from a part transposed a step lower. This put him into keys with two more flats, or two fewer sharps, than the other players. (For example, in the F-sharp minor "Buss und Reu" heard here, the organist played in E minor.) What character comes into the music from the keyboard temperament? Recording method: I played all the Werckmeister examples first, then spent about 10 minutes retuning the harpsichord (and changed shirts), then played everything again. The results are edited together here with commentary. More resources: Part 2 is here
