Law 271: Environmental Law and Policy - Lecture 28 Preemption Instructor Holly Doremus. This introductory course is designed to explore fundamental legal and policy issues in environmental law. Through examination of environmental common law and key federal environmental statutes, including the National Environmental Policy Act, Clean Air Act, and Clean Water Act, it exposes students to the major challenges to environmental law and the principal approaches to meeting those challenges, including litigation, command and control regulation, technology forcing, market incentives, and information disclosure requirements. RR Traffic Signal Preemption Malfunction at Echo Lake Road Video taken on July 25th, 2007 at Echo Lake Road in West Milford, NJ. Notice the traffic signal pre-emption cycle for the railroad is delayed in starting. Normally, pre-emption occurs 30 seconds before the crossing signals activate by displaying a red light at the traffic signal before the crossing. The purpose is keep cars from proceding through the light and stopping on the tracks while the train is approaching. In this video, pre-emption occurs about 10 seconds AFTER the railroad crossing signals activate. Luckily this isn't a very busy road and the risk is minimal.

Los Angeles County Board of Supervisors Calls For Repeal of Federal Cell Tower Health Preemption The Los Angeles County Board of Supervisors voted unanimously in early June to actively seek and support federal legislation to repeal portions of the Telecommunications Act of 1996 that limit the authority of state and local governments to regulate cell towers and related wireless facilities on the basis of their health and environmental effects. The motions by Supervisors Zen Yaroslavsky, Michael Antonovich and Mark Ridley-Thomas cited "ongoing debate within the scientific community and among governing bodies throughout the world regarding how thoroughly the long-term health effects of low-frequency electromagnetic and radio-frequency emissions are understood" and "questions...regarding how well the existing regulations established by the Federal Communications Commission [FCC] protect more vulnerable populations such as school-aged children, and how well they protect against the cumulative effect of radio-frequency emissions on people who live or work in close proximity to multiple cellular facilities." 11. Safety Claims and Free Speech: Preemption and Defamation Environmental Politics and Law (EVST 255) This lecture presents three cases: Bates v. Dow, a lawsuit brought by peanut growers against the producers of a pesticide that degraded their soil; the Alar case, in which environmental organizations and the media successfully pressured EPA to ban a carcinogenic pesticide used on apples; and the Texas Cattlemen's Association's lawsuit against Oprah Winfrey for her coverage of Mad Cow Disease. Using these three cases, Professor Wargo discusses the legal concepts of preemption and defamation. He gives an overview of their origin and use in regulating agriculture and protecting human health and the environment. Through the Texas Cattlemen's Association case, he shows the effect of state "veggie libel" laws on free speech.
