  • Scotts Valley Mayor Brown Act Violation Investigation At the April 15, 2009 City Council Meeting Mayor Randy Johnson threatened police action if a speak during the public comment period did not change the topic. This is particularly egregious due to the fact that the speaker was asking the Mayor to recuse himself from the discussion due to a possible conflict of interest. This was an abuse of power and intimidation by the Mayor who may only restrict public comment to effectuate a compelling state interest.
  • Why We Fight: The Battle of China (Frank Capra) "The Battle of China," Chapter VI of Frank Capra's "Why We Fight" series, explains why the Empire of Japan possessed such a strong interest in ruling the disparate lands of China. In an attempt to break the will of the Chinese people in one massive assault, Japan invades Nanking and massacres forty thousand civilians. The attack results in an opposite effect, galvanizing the Chinese resistance and unifying the separate lands into a single Chinese identity. While the Japanese take control of all Chinese ports, hoping to cut off all resources from its victim, China's allies effectuate an engineering miracle. They construct the seven hundred mile long Burma Road over the mountains of Myanmar, and set up a constant caravan of trucks to ship food and materiel to the Chinese armies, keeping them alive. Frustrated by their inability to conquer China, the Japanese turn their attention to the islands of the Pacific, and the United States.
  • Video Interviews from BCLT's Browser Privacy Mechanisms Roundtable at Berkeley Law Wednesday, February 9th 2011 Bancroft Hotel, Berkeley The Federal Trade Commission preliminary staff report, "Protecting Consumer Privacy in an Era of Rapid Change," calls generally for privacy by design, and specifically for a do not track (DNT) system to allow consumers to better control online collection of information. This is a challenging task, because many web interactions require a transfer of information that could be conceived of as "tracking." The major developers of browsers have all announced implementations of do not track systems recently. The conceptions of DNT have different needs for implementing regulation and have different implications for businesses and consumers. This roundtable explored the contours of the regulations needed to effectuate do not track, the technical options to implement it, and the political and economic implications of do not track systems.   • Can I get arrested for DWI if I smoke Marijuana and Drive in Austin, Texas The DWI or Driving While Intoxicated statute in Texas is two fold as it pertains to the definition of intoxication. According to the Texas DWI statute a person is intoxicated either because they have a blood alcohol concentration of over a .08 or they have lost the normal use of their mental or physical faculties due to the introduction of alcohol, a controlled substance, a drug, a dangerous drug, or any substance or combination of those substance into the body. Marijuana is defined as a drug. For minor possession of Marijuana charges in Austin Texas an officer has the discretion in certain situations to issue a ticket instead of a custodial arrest. It is still illegal. The non-custodial arrest will still go on your criminal history, but the officer can issue the citation rather than effectuate a custodial arrest.   • Closing Argument Simulation - Self-Defense - Eli Federman The names have been changed to preserve the confidentiality of my client. This simulation is based on the charge of Third Degree Assault (NY Penal Law §120.00). Please feel free to critique this dramatic performance. This case was ultimately dismissed on Sixth Amendment speedy-trial grounds [See, CPL § 30.30(b)] ! In short, the Assistant District Attorney could not get the complaining witness to sign a document, within the required time period, corroborating the allegations. The charges were Assault in the Third Degree and Harassment in the Second. The Standards on Speedy Trial and Timely Resolution of Criminal Cases have three main purposes: (1) to effectuate the right of the accused to a speedy trial; (2) to further the interests of the public, including victims and witnesses, in the fair, accurate, and timely resolution of criminal cases; and (3) to ensure the effective utilization of resources.   • VASIMR Fires At Full Power For 15 Seconds This video shows the VASIMR VX-200 during a 30 second firing of it's first stage, and a 15 second firing of it's second stage. The Astra Rocket Companys VASIMR® VX-200 rocket prototype reached its highly-coveted 200 kW maximum power milestone at 11:59 am (CST) September 30th 2009 in tests conducted at the companys Houston laboratory. The DC power trace actually exceeded the design requirement by 1 kW and exhibited the clear signature of a well established plateau at peak power. The achievement comes after an intense experimental campaign that began in April 2009 when the engine was fitted with a powerful low temperature superconducting magnet, a critical component that enables VASIMR® to process large amounts of plasma power. The electrical power processing is accomplished using high efficiency, 95%, solid state RF generators built by Nautel Ltd of Halifax, Canada. Demonstration of a 200 kW capability was required to validate, with full scale performance data, the design of the VF-200-1 already underway. The VX-200 turns out to exceed the expected power density of VF-200-1 by about 25%, so this is a robust demonstration of the technology. The VF-200-1 is the first engine that the company plans to fly in space, and it is presently working with NASA to effectuate inspace testing in late 2013 on the International Space Station (ISS).
