  • Chief Graham Discreditable Conduct VICTORIA - An investigation of Victoria Police Chief Jamie Graham's comments has determined it was a case of discreditable conduct. Graham came under fire for comments he made about Olympic protestors who came over from the Lower Mainland for the start of the torch relay. The protestors successfully knocked the torch off-course. At a security conference a month later - Chief Graham said "a cop" was driving a bus load of demonstrators. The first complaint filed by a Victoria man of breach of public trust was found unsubstantiated. The second complaint by the BC Civil Liberties Association of discreditable conduct was found to be valid by an investigating RCMP Chief Superintendent. The investigation did not determine if the statement by Graham was true but felt is was discreditable either way by placing an undercover officer in danger or by having a hig-ranking police officer making untrue statements in a public venue. The disciplinary authority, Victoria Mayor Dean Fortin, is recommending a letter be placed in Chief Graham's personnel file. The process is far from over. The Chief, the complainants and even the overseeing body the Office of the Police Complaints Commission can ask for a pre-hearing conference. And if the findings or discipline are in dispute, a retired judge may be called in to reopen the investigation.

  • Police Chief exonerated VICTORIA - Victoria's Police Chief has been exonerated following an allegation that he pre-determined the result of a complaint to BC's Police Complaint Commissioner. When two plainclothes Victoria Police officers pulled over a mini-van early one morning in February 2008, it was the beginning of a series of complaints against the department. Mike Stebih complained the stop and subsequent search of his van were illegal. He asked to see the plainclothes officer's identification before showing his driver's license. But the officer refused. Moments later Stebih was being wrestled to the ground and charged with obstruction for not producing his licence At his trial Stebih produced a recording of the stop that appeared to contradict the Victoria Police officer's testimony. Stebih then complained to BC's Police Complaint Commissioner. Three years after the traffic stop, the officers were found to have abused authority, neglected duty, and to have shown discreditable conduct. The officers received a range of discipline including suspension and closer supervision. But it was a comment to /A\ News by Victoria's Police Chief that expanded Mike Stebih's complaint.
